INTRODUCTION


Welcome to Roots to Rise Counseling, LLC ("we," "us," "our," or "the Practice"). These Terms and Conditions ("Terms," "Terms and Conditions," or "Agreement") govern your access to and use of our website located at www.rootstorisecounseling.com (the "Website"), our therapeutic services, and any related services provided by Teresa Grechenkov, LCSW (collectively, the "Services").


By accessing our Website, scheduling an appointment, or receiving our Services, you ("Client," "you," or "your") agree to be bound by these Terms and Conditions and our Privacy Policy and Notice of Privacy Practices. If you do not agree with these Terms, please do not use our Website or Services.


PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR SERVICES.




1. ACCEPTANCE OF TERMS


By using our Website or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy and Notice of Privacy Practices. These Terms constitute a legally binding agreement between you and Roots to Rise Counseling, LLC.


If you are accepting these Terms on behalf of a minor child for whom you are the parent or legal guardian, you represent and warrant that you have the legal authority to bind that minor to these Terms.




2. MODIFICATIONS TO TERMS


We reserve the right to modify, amend, or update these Terms at any time. Changes will be effective immediately upon posting to our Website. The "Last Updated" date at the top of this document will reflect the date of the most recent changes.


Your continued use of our Website or Services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically. If you do not agree to any changes, you must discontinue use of our Website and Services.


Material changes will be communicated to active clients via:

- Email notification

- Notice on our Website

- Discussion during your next scheduled session




3. ELIGIBILITY AND SCOPE OF SERVICES


ELIGIBILITY:

Our Services are intended for individuals who:

- Are 18 years of age or older (for individual therapy)

- Are residents of the State of Indiana

- Have the legal capacity to enter into this Agreement

- For family therapy involving minors, appropriate parental/guardian consent will be obtained


SCOPE OF SERVICES:

Roots to Rise Counseling provides virtual mental health counseling and therapy services, including but not limited to:

- Individual therapy for women in midlife

- Family therapy

- Treatment for anxiety, depression, and burnout

- Support for religious trauma and faith transitions

- Life transition counseling

- People-pleasing and boundary work


SERVICES WE DO NOT PROVIDE:

- Emergency or crisis intervention services

- Medication management or prescription services

- Court-ordered evaluations or therapy

- Forensic evaluations

- Custody evaluations

- Letters for emotional support animals (ESAs)

- Disability determinations




4. PROFESSIONAL RELATIONSHIP


THERAPIST-CLIENT RELATIONSHIP:

The relationship between you and Teresa Grechenkov, LCSW, is a professional therapeutic relationship. This relationship exists solely during scheduled therapy sessions and related professional communications.


NOT COVERED BY THESE TERMS:

- These Terms do not create a doctor-patient relationship for medical treatment

- Services are limited to mental health counseling within the scope of practice for a Licensed Clinical Social Worker in Indiana

- We do not provide emergency services or crisis intervention


NO GUARANTEE OF RESULTS:

While we strive to provide high-quality therapeutic services, we cannot and do not guarantee any specific results or outcomes from therapy. Mental health treatment is a collaborative process, and outcomes depend on many factors including your commitment, participation, and individual circumstances.




5. VIRTUAL/TELEHEALTH SERVICES


TELEHEALTH AGREEMENT:

All therapy services are provided virtually through HIPAA-compliant, encrypted telehealth platforms. By using our Services, you acknowledge and agree to the following:


YOUR RESPONSIBILITIES:

- Ensure you are in a private, confidential location during sessions

- Use a secure internet connection (avoid public Wi-Fi networks)

- Use headphones to maintain confidentiality

- Have a backup plan in case of technology failure

- Keep your device and accounts secure with strong passwords

- Be located in the State of Indiana during all sessions

- Inform the therapist if anyone else can hear the session


TECHNOLOGY REQUIREMENTS:

- Reliable high-speed internet connection

- Device with camera and microphone capabilities

- Updated browser or telehealth application

- Email access for appointment confirmations and communication


LIMITATIONS OF TELEHEALTH:

- Technical difficulties may occur and may result in session interruption

- The therapist cannot provide the same physical observations as in-person therapy

- In case of emergency, 911 should be called immediately as the therapist cannot provide emergency intervention through telehealth


SECURITY:

While we use secure, HIPAA-compliant platforms, we cannot guarantee the absolute security of information transmitted over the internet. You acknowledge and accept these risks.




6. APPOINTMENTS, SCHEDULING, AND CANCELLATION


SCHEDULING APPOINTMENTS:

Appointments may be scheduled by:

APPOINTMENT CONFIRMATION:

You will receive email confirmation of scheduled appointments. It is your responsibility to ensure we have your correct email address and that you check for appointment confirmations.


CANCELLATION POLICY:

We understand that circumstances may require you to cancel or reschedule an appointment. However, we require at least 24 hours advance notice for any cancellation or rescheduling.


- Cancellations made less than 24 hours before the scheduled appointment time may be charged the full session fee

- Late cancellations and no-shows do not qualify for insurance reimbursement

- You are responsible for the full fee for late cancellations and no-shows

- Exceptions may be made for emergencies at the therapist's discretion


LATE ARRIVAL:

If you arrive more than 15 minutes late to your scheduled session, the session may need to be shortened or cancelled, and you may be charged the full session fee.


THERAPIST CANCELLATION:

In the event that the therapist must cancel your appointment, you will be notified as soon as possible and will not be charged for the session.


MISSED APPOINTMENTS:

Repeated missed appointments or late cancellations may result in termination of services.




7. FEES, PAYMENT, AND BILLING


SESSION FEES:

Current fees are as follows:

- Individual therapy (53 minutes): $150 (introductory rate)

- Family therapy (53 minutes): $175


Fees are subject to change with 30 days advance notice to current clients.


PAYMENT METHODS:

Payment is required at the time of service unless other arrangements have been made in advance. We accept:

- Credit cards

- Debit cards

- Electronic bank transfers

- Other payment methods as arranged


INSURANCE:

At this time, we operate on a self-pay (private pay) basis. We do not directly bill insurance companies. However, we can provide you with a detailed receipt (superbill) that you may submit to your insurance company for potential out-of-network reimbursement.


It is your responsibility to:

- Understand your insurance benefits and out-of-network coverage

- Submit claims to your insurance company

- Pay the full session fee at the time of service


GOOD FAITH ESTIMATE:

In accordance with federal law, you have the right to receive a Good Faith Estimate of expected charges for services. This information is provided during intake and is available on our Website and upon request.


RETURNED PAYMENTS:

A fee of $35 will be charged for any returned checks or failed payment transactions.


COLLECTIONS:

In the event of non-payment, your account may be sent to collections. You will be responsible for all costs associated with collections, including reasonable attorney fees.


SLIDING SCALE:

Limited sliding scale spots may be available based on financial need. Please inquire about availability.




8. CANCELLATION AND REFUND POLICY


NO REFUND POLICY:

All fees paid for completed services are non-refundable. Once a therapy session has been conducted, payment for that session is final.


ADVANCE PAYMENT:

If you have paid for services in advance and need to discontinue therapy, unused session fees may be refunded on a prorated basis at the therapist's discretion.


CHARGEBACKS:

Initiating a chargeback for services that have been rendered constitutes a breach of these Terms and may result in:

- Immediate termination of services

- Referral to collections

- Report to credit agencies

- Potential legal action


DISPUTES:

If you have concerns about billing or fees, please contact us directly at teresagrechenkov25@rootstorisecounseling.com to resolve the matter before initiating any chargeback or dispute with your financial institution.




9. CLIENT RESPONSIBILITIES


As a client receiving therapeutic services, you agree to:


PARTICIPATION:

- Attend scheduled appointments on time or provide adequate notice of cancellation

- Actively participate in the therapeutic process

- Complete any agreed-upon assignments or homework between sessions

- Provide honest and complete information relevant to your treatment

- Ask questions when you do not understand something


SAFETY:

- Inform the therapist of any safety concerns, suicidal thoughts, or thoughts of harming others

- Not attend sessions while under the influence of alcohol or non-prescribed drugs

- Maintain a safe and appropriate environment during virtual sessions


COMMUNICATION:

- Respond to appointment confirmations and requests for information in a timely manner

- Notify the therapist of any changes to your contact information

- Use secure methods of communication as directed by the therapist


RESPECT:

- Treat the therapist with respect and professionalism

- Not engage in threatening, harassing, or inappropriate behavior

- Respect professional boundaries


PAYMENT:

- Pay for services in accordance with the fee schedule

- Provide updated payment information as needed

- Communicate any financial concerns or hardships




10. CONFIDENTIALITY


Our complete confidentiality practices are detailed in our Privacy Policy and Notice of Privacy Practices. By using our Services, you acknowledge that you have read and understand those documents.


GENERAL CONFIDENTIALITY:

Information shared during therapy sessions is confidential and will not be disclosed without your written authorization, except as required or permitted by law.


EXCEPTIONS TO CONFIDENTIALITY:

As required by Indiana law and ethical guidelines, confidentiality may be broken in the following situations:

- You pose an imminent danger to yourself or others

- Suspected abuse or neglect of a child, elderly person, or dependent adult

- A court order or subpoena requires disclosure

- You provide written authorization to release information

- Consultation with other healthcare professionals (information is shared only as necessary for your treatment)


FAMILY THERAPY:

For family therapy, confidentiality issues will be discussed at the outset of treatment, including how individual and family session information will be handled.


MINORS:

Parents and legal guardians generally have the right to access their minor child's treatment information. However, Indiana law provides certain confidentiality rights to minors. These will be discussed as part of the informed consent process.




11. ELECTRONIC COMMUNICATIONS


EMAIL COMMUNICATION:

Standard email is not a secure form of communication. While we may use email for:

- Appointment scheduling and reminders

- Billing questions

- Administrative matters


We will not discuss therapeutic content or sensitive information via unsecured email. By providing your email address, you consent to receiving administrative communications via email.


TEXT MESSAGING:

Text messages are not secure. We may use text messaging for appointment reminders only, with your consent.


EMERGENCY COMMUNICATIONS:

Do not use email or text messages to communicate emergencies or urgent matters. In case of emergency:

- Call 911

- Go to your nearest emergency room

- Call the National Suicide Prevention Lifeline: 988

- Text HOME to 741741 (Crisis Text Line)


RESPONSE TIME:

We are not able to provide immediate responses to electronic communications. Please allow up to 24 hours for a response during business hours. Messages received after business hours or on weekends will be responded to on the next business day.




12. RECORDS AND DOCUMENTATION


CLINICAL RECORDS:

We maintain clinical records as required by Indiana law and professional standards. You have the right to access your records as described in our Privacy Policy and Notice of Privacy Practices.


RECORD RETENTION:

Records are retained in accordance with Indiana law:

- Adult clients: Seven (7) years from the date of last service

- Minor clients: Until age 25 or seven years from last service, whichever is longer


REQUESTS FOR RECORDS:

Requests for copies of records must be made in writing. There may be a reasonable fee for copying and mailing records.


THIRD-PARTY REQUESTS:

We will not release records to third parties without your written authorization, except as required by law. This includes:

- Attorneys

- Courts

- Schools

- Employers

- Other healthcare providers


LETTERS AND REPORTS:

We generally do not provide letters or reports for purposes such as:

- Court proceedings

- Custody evaluations

- Disability determinations

- Emotional support animal (ESA) letters

- Return to work letters (except in limited circumstances)


If such documentation is requested and the therapist agrees to provide it, there will be an additional fee and it will be subject to the therapist's professional judgment.




13. CRISIS SITUATIONS AND EMERGENCIES


NOT A CRISIS SERVICE:

Roots to Rise Counseling is NOT a crisis center and does not provide emergency or crisis intervention services.


IN CASE OF EMERGENCY:

If you are experiencing a mental health emergency or are in immediate danger, you should:

- Call 911

- Go to your nearest emergency room

- Call the National Suicide Prevention Lifeline: 988

- Text HOME to 741741 (Crisis Text Line)

- Contact your local mobile crisis team


AFTER HOURS:

Our practice does not provide after-hours emergency services. If you need support outside of scheduled session times, please use the emergency resources listed above.


SAFETY PLANNING:

As part of treatment, we will work together to develop a safety plan that includes emergency contacts and resources appropriate for your situation.




14. TERMINATION OF SERVICES


VOLUNTARY TERMINATION:

You have the right to terminate therapy at any time. However, we encourage you to discuss your decision during a session to ensure appropriate closure and, if desired, referrals to other providers.


THERAPIST-INITIATED TERMINATION:

The therapist may terminate the therapeutic relationship under the following circumstances:

- You have not made payment for services

- You have repeatedly missed or cancelled appointments

- You engage in threatening, harassing, or inappropriate behavior

- The therapist determines that they are not qualified to provide the services you need

- The therapist determines that you are not benefiting from services

- A conflict of interest arises

- You engage in behavior that compromises the therapeutic relationship


NOTICE OF TERMINATION:

If the therapist terminates services, you will be provided with:

- Reasonable notice (except in cases of threatening behavior)

- Appropriate referrals to other providers

- Assistance in transitioning care, if requested


FINAL SESSION:

When possible, a final session is recommended to:

- Review progress

- Discuss future goals

- Provide referrals if needed

- Ensure appropriate closure


OUTSTANDING BALANCES:

Any outstanding balance must be paid upon termination of services.




15. INTELLECTUAL PROPERTY


WEBSITE CONTENT:

All content on our Website, including but not limited to text, graphics, logos, images, and software, is the property of Roots to Rise Counseling, LLC, or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.


RESTRICTIONS:

You may not:

- Reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any of the material on our Website without our prior written consent

- Use our Website or any of its content for any commercial purpose without our express written permission

- Use our name, logo, or any of our trademarks without our written permission


THERAPEUTIC MATERIALS:

Any handouts, worksheets, assessments, or other materials provided during therapy are for your personal use only and may not be shared, reproduced, or distributed without permission.




16. LIMITATION OF LIABILITY


To the fullest extent permitted by law:


NO WARRANTY:

The Services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.


We do not warrant that:

- The Services will meet your specific requirements or expectations

- The Services will be uninterrupted, timely, secure, or error-free

- Any particular results or outcomes will be achieved through therapy


LIMITATION OF LIABILITY:

Roots to Rise Counseling, LLC, and Teresa Grechenkov, LCSW, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

- Your use or inability to use the Services

- Any conduct or content of any third party related to the Services

- Unauthorized access, use, or alteration of your transmissions or content


MAXIMUM LIABILITY:

In no event shall our total liability to you for all damages exceed the amount you paid us for Services in the three (3) months preceding the event giving rise to the liability.


ACKNOWLEDGMENT:

You acknowledge that the fees charged for our Services reflect these limitations of liability and that we would not provide Services at these fees without these limitations.




17. INDEMNIFICATION


You agree to indemnify, defend, and hold harmless Roots to Rise Counseling, LLC, Teresa Grechenkov, LCSW, and any of our employees, contractors, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with:

- Your access to or use of the Services

- Your violation of these Terms

- Your violation of any third-party right, including any copyright, property, or privacy right

- Any claim that your use of the Services caused damage to a third party




18. EXTERNAL LINKS AND THIRD-PARTY SERVICES


THIRD-PARTY WEBSITES:

Our Website may contain links to third-party websites or services that are not owned or controlled by Roots to Rise Counseling, LLC.


We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. THIRD-PARTY SERVICES:

Our Services utilize certain third-party platforms and services, including:

- SimplePractice (EHR and scheduling)

- Secure telehealth platforms

- Payment processors

- Website hosting (Squarespace/Google Workspace)

- UserWay (accessibility widget)


These third-party services are governed by their own terms of service and privacy policies.




19. DISPUTE RESOLUTION


INFORMAL RESOLUTION:

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Services, you agree to first contact us to attempt to resolve the dispute informally by contacting:

MEDIATION:

If the dispute cannot be resolved informally within 30 days, both parties agree to submit the dispute to mediation before pursuing litigation.


GOVERNING LAW:

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions.


JURISDICTION:

You agree that any action at law or in equity arising out of or relating to these Terms or the Services shall be filed only in the state or federal courts located in Kosciusko County, Indiana, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.


WAIVER OF CLASS ACTION:

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.




20. GENERAL PROVISIONS


ENTIRE AGREEMENT:

These Terms, together with our Privacy Policy and Notice of Privacy Practices, constitute the entire agreement between you and Roots to Rise Counseling, LLC, regarding the use of our Website and Services.


SEVERABILITY:

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.


WAIVER:

We shall not be liable for any failure to perform our obligations under these Terms where such failure results from any cause beyond our reasonable control, including but not limited to mechanical, electronic, or communications failure or degradation, natural disasters, acts of terrorism, or governmental actions.


NOTICES:

Any notices or other communications provided by us under these Terms will be given by email to the email address you provide or by posting to our Website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
